Has anyone attended a US Home Auction? They are coming to Orlando, FL in 2 weeks...I found a home I want, but the starting bid is only $40,000. If no one challenges me, will I really get this home for that?
US home auction? Good day.. I was recently watching an information for US home auction. They are selling foreclosed homes. Has anyone been to this auction recently and what are the pros and cons involved in purchasing a foreclosed home.
What do you do when youve lost your paid off home to a flood, and waited 4 years for fema to do nothing ? Thats right !!! Our home was severly damaged in a flood 4 years ago and it WAS declared a disaster area. Fema gave us $800 for a footer and never went under the house. Then they said it qualified to be bought out and after 4 years of government runarounds and the roof collapsing and FEMA not coming up with any more money we had to sell it and take a $40,000 loss !!! We never got a credit card like Katrina victims or any other assistance. We had to evacuate the premises immediately on our dime with no help from the government and relocate. We have spent nearly $25,000 bucks in rent waiting on them to say we don't have the money yet to buy your 49,000 dollar home !!! A construction company had been really pestering us to buy it and we got fed up and sold it. Now we are looking at foreclosures and bank repo's and home auction websites, but people with more money than us keep outbidding us on homes that we see and like !!! My mother passed on leaving her home and a small amount of debt with no will can her home be taken from us? I have contacted her creditors and I have keept up her monthly mortage along with paying some of the smaller bills(credit cards) My sister and I are the only living relatives and agree that we will sell her home and pay off any open balances she has. yet I've been told that it does not matter what we do probate will take her home and auction it off and leave us with nothing. Can this really be correct information. please help me get a better understanding.
How much should we offer on the home of our dreams? The house is listed for a quick sale at right below 200,000-too much for us. Home will go to auction in August. Home is in Putnam County IN, has 10 acres, 3 bedrooms, 3.5 bathrooms, 3 car attached garage, bonus room. There is no central air, all flooring needs to be replaced, kitchen is outdated, roof appears to need some work, needs painted on inside and out, some holes in siding, missing light fixtures on garage and the ones that are there do not match, outside and inside trim missing, no railing on staircase, no dishwasher, appliances included are very outdated, behind house is old boat, lots of trash, old motors and a very rundown shed, and the kitchen floor has a mysterious bump in it(possible foundation issue). All these things were noticed during an informal 5 minute tour of the property. Any help anyone can give us in coming up with a reasonable offer will be greatly appreciated. Our realtor is the listing agent on the property so we aren't expecting much help from him.

when mortg. bank lies to you after they sold home on auction...? indymac bank ...well. they sold the house on auction, yet later a rep told me on a phone that it's still 'bank owned'. what a lie..? long story short, they refused shortsale offer i made last year, so what was i to do? i filed for bankruptcy and got discharged with chapter 7. indymac kept reporting to my credit agencies that 'its still open and i still owe them full', yet in fact, they bought the house on trustee auction to make it as 'bank owned' for such a long while, and i today found they sold it on july 15, 2008. when i called indymac to discuss why they keep reporting that i owe them full amt --- to my credit agencies ----, a rep said 'it's not sold yet, if its sold, then we will stop. even if you filed chap 7/discharged, etc. doesnt mean you don't owe us.' i was like... what??? i asked the rep if i can have that in writing to present to a lawyer, and he acted like he didnt care much. im to call indymac tomorrow and see if still a rep tells the lie, that 'home isnt sold yet, sorry'. i wish i can record this but probably wont be able to. i verified with a realtor, and today i went to view the house myself, and talked to neighbor that YES the home was sold! any advice? i feel very weak when i speak to indy on a phone just crying out loud whining, yet just feel so powerless when thats what they give me... :( sigh. they refused my shortsale offer in 07, i'm afraid they will report my credit agencies i owe them the original - selling price BUT i doubt i owe them still. not sure how tax return will be next year but... i must contact irs about situation, right???? thanks...
How fast can you stop a trustee auction on a home? We found a property in California that we like. The property is due to be auctioned off on Tuesday at 10:00 AM. We put in a bid and it was basically accepted pending the approval of a short sale. Basically, the seller wants to sell to us, and I would assume the bank would want to sell to us and not have the home go to auction on Tuesday. However, we're not sure if the auction can be canceled by Tuesday, mostly because the bank will be closed on Monday due to the holiday. The agent for the seller says he's pretty sure the bank will approve the short sale if we can stop the property from going to auction but again, it's supposed to be auctioned on Tuesday morning. So I guess my question is, does anyone know how fast a property auction can be canceled/postponed? If the bank employees come in at 9 AM on Tuesday and the property goes to auction at 10 AM, would they be able to cancel/postpone the auction within that hour?
Cash for Keys- how do I go about it, when my home is going to auction? We have been sent forms (rental application)from HUD to have the option of renting back at market value, if the house we own is bid on and it goes back to the bank. We are afraid that market rent(which they said we would have to pay, if they approve our application)may be too high for us, and so we probably will need to move. We don't know how to go about getting what they call "Cash for Keys" Once the House is foreclosed on.

Won a Foreclosure home at Auction, what is the best type on financing to allow for repairs also? We won a foreclosure home at auction. Upon completion of the appraisal, the bank denied our loan due to the condition of the home (it needs new siding but isn't terrible, mold remediation in basement, finish the current unfinished repairs throughout the home) but it isn't a complete mess. Is there a type of loan out there that will allow us to close on the house 'as-is' and get the money to make the necessary repairs? We were supposed to close on the 23rd, but we have an extension to look for another source of funding. Originally our loan officer tried for a conventional, but would rehab financing or a 203k loan be the way to go? Our lawyer recommended a construction loan which also sounded good. I don't know much about loan types and figured the kind people here would know what would be a better route for a foreclosure. Complete cost for all repairs and labor by licensed contractors should be around 20k
when will i no my home has been auctioned off by the bank? I lost my home in forclosure and the bank bought it bk for $100. Now how will I now what happens now. They tell us nothing and we are wondering what happens when the see it at auction. What will we own--How will they get there money?
Has anyone been a victim of their property taxes being sold @ auction & losing their home? Without our knowledge, our property taxes were sold @ auction ( we received notice AFTER the sale had already been conducted-of course, the county denied this saying they notified us). Has anyone else had this happen to them, what state & county do you live in & what happened? Did you lose your home or did you find a way to "fix" this & what did you do? Our home is paid for & because my husband & I are both disabled w/children, we applied for property tax credit. Our county neglected to let us know if we got approved. The 1st time we applied, they never let us know the outcome & when I finally contacted them, they told us we were too late. So there went one year of taxes. We applied again & I contacted them last Aug, at which time we were informed that, yes, we were approved, but if we didn't come up with the $5K from the last 2 years, that the person who "bought" our taxes could take our home. Can I conduct a home inspection on an REO property I won at an auction? My parents recently "won" a property on auction. The home is an REO and in good condition, but not great condition. The winning bid did not meet the reserve price, so the sale is pending upon the approval of the asset manager. However, my parents are currently in escrow right now and have made a deposit on the home. Although we realize the home is being sold "as-is", my parents still want to conduct a home inspection. If the house is in terrible condition, my parents may want to back out of the offer knowing that we will lose part of the deposit. The selling agent on the home is informing me that we are not allowed to do a home inspection until the close of escrow and we are not allowed on the property. Given that we are in escrow already, does this sound right? Shouldn't we have the right to conduct a home inspection and know what we are buying? My parents have been to the home and did a walk through of the property, and it does look sound, but we would like a formal inpection nevertheless. The agent did tell us that we were supposed to do the home inspection 2 weeks prior to the auction (during the open house period), but my parents didn't want to do an inspection and pay $400 on a property they weren't sure they were going to get. Is this agent correct? TIA
My Last Attempt To Save My Home Before Public Auction Aug 2 - Feeling totally betrayed by Bank of America? I'm going to do my best to not make this a long drawn out sob story, but I have been given the run around by Bank of America since October who has been telling me about my options to save my home since January when they denied me modification. Our 4br 3 bath home is located in a brand new community between Livermore and Tracy. My girls and I purchased this home alittle over 3 years ago. Bank of America would not discuss options unless I was in default my 3 months. I wish I could go back, but I can't. I have been listening to possible options for months. Every option I was absolutely willing to consider, but every time I said Yes, send me the paperwork to get something started the paperwork never showed up. Obviously they pretend to want to help, but do nothing but put people in a foreclosure pile the minute you are behind. A small modification by just a couple of hundered dollars and my girls and I would not be in this situation. Instead we are forced to live hopeful for months and trust that my lender will want to compromise somehow. After all, why would they refuse to help. They don't need any more foreclosdures and don't want to take my home away from me and my two little girls. WRONG! Friday I recieved notices taped to my front door that our home was up for public auction on August 2nd. WOW! Just yesterday I had options and today I have none. I am behind $18,0000, and at this point I know there is no way I can recover from this in 21 days. If I knew Bank of America was going to throw me under the bus and had no intention of helping me I could have and would have figured things out. My biggest mistake was BofA wanted to help me. Just this week I have had numerous real estate people call with offers of short sale. Honestly, I could care less about a foreclosure on my credit at this point. I really need someone who can just be sincere and honest and let me know how I can stop my home from being sold on Auguat 2nd so I can figure things out now that I know Bank of America is the enemy. I just need time.... How can I stop this? Who should I contact to get back on track? This is our home... I don't need vultures wanting to profit from my loss. I understand that every real estate agent can sell my home and I can avoid this or that... So what! I need someone who can tell me how I can save our home and take the worry away from me and my girls. I CAN RECOVER FROM THIS. I CAN GET THROuGH THIS FINANCIAL NIGHTMARE. We are waiting for our HUD home to close. What are our rights when no one will talk to us? We won our HUD home in an auction on November 24th. It is now almost January and we do not know what is going on. I understand that HUD homes can take up to 60 days, but we have to be out of our apartment on Monday. Someone at the title company told us the 29th as a tentative date to close on the home. Well, it is now the 31st and the title company won't even talk to us. They wouldn't even talk to the realtor. He called and emailed 5 people at the company and only got an email from them saying that they never told us the 29th. I have left a message and emailed the woman in charge of our closing and still no response. We were told that our deal is in scheduling. We are also paying cash for this house so there is no loan to worry about. I think it is totally unprofessional that this company will not return our phone calls or emails. We want answers and are ready to actually go downtown and pay them a visit in person so they have to talk to us. Do we have any rights in this situation? We are totally understanding of the fact that this takes longer being a HUD home and that it's the holidays, but I think we should at least have an explanation of how much longer it may take. We absolutely have to be out of our apartment on Monday! Edit: we did not terminate our lease on the assumption that we would have our house. Our lease happened to be ending on January 1st, and we had to sign something 60 days before that saying we wanted to leave. At that time we had another house already purchased which burned down a week after we bought it. Our apartment management is allowing us to stay until the 5th, but then someone else is moving in and we need to be out. The circumstances of our living situation were out of our control.

Foreclosed home and auction? Ok, I have a few questions about what happens when a house is put up for auction. At that point is there any way to save it? My family has been trying to work with the mortgage company to modify our loan yet our house went to auction today. Also, when do you get a written notice about the auction? If there is one? We were only informed of the auction after a man came to our door at 11.30 am to look at the house and told us that at 12pm our house would be put up for auction. How long do we have to vacate, or who to call about this? We're packing just in case but really we have no where to go. My grandfather owns the house, I live here to help take care of them and my mother. I was unaware about the delinquent mortgage payments. We have no real income. I get paid to take care of my mom and they get benefits. I live in Oakland, CA if you need to know.
Buying a foreclosed home at auction In Northern California - advice please? My husband and I have been following a house that has just had its auction date listed for later this month. It was originally on the market for $479,000.00. We went to look for a laugh and it was WAY over priced. This was later reduced to $419,000 which we discovered was the amount owing. We started working on the owners and the bank with a short sale - the bank valuation came back at $319,000. We offered $300,000 and it was accepted. During this time we had a full inspection done as our families are builders and contractors and realized that the house was a tear-down essentially as it needed new ceilings, roof, foundations, flooring and had wood rot and mould. We retracted our offer and the property moved into foreclosure. I still love the land it is on, and so if we can get for a good price we would like to tear down the house and rebuild. Our family is helping us as this is our first house and we have a line of credit available. 1) Do banks set a minimum bid or does the lowest bid get it. They have not posted an opening bid yet. (we have a figure in mind that is market value for a comparable piece of unimproved land) 2) Can you speak to them beforehand and make an offer so to avoid the auction day? (this is not a property that is likely to have more than one bidder) 3) We have been told we need to pay cash, but when? If it is on the day then how do we know how much to get a check for? Can we put down a deposit on the day and then pay the balance? 4) Does an auctioned house come with free title? That was one thing we couldn't make sure of before bidding. 5) Someone told me that the owners have a certain amount of time after the auction to pay up and get the house back - is this right or is the house mine from the time the money changes hands? Question about rental home going in to foreclosure? I have neighbors that rent the home across the street from us. They told us about a month ago that the house was going up for auction. The auction was on the courthouse steps today and no one bid on the house. They tried to buy the house, but they don't have much cash and no credit. How long till we must vacate our foreclosed home in Phoenix, AZ that sold at auction just over a week ago? Our home in Phoenix, AZ was foreclosed and auctioned off to an investors group recently. The representatives that have come to speak to us initially said we could "sit tight" here for a little bit while the group contemplated what they were gonna do with the property yet if we were interested in staying in the home, they would accept us as tenants at the current market rental value for our area. They told us a few days later that the owners have decided they'd prefer to have us leave as soon as possible so they can get started with refreshing the property and reselling it instead and would be willing to let us sign a lease and pay for through the rest of this month, or help us contact salvation army or whatever community aid program to perhaps help us make the transition. Otherwise, they'll have to begin the eviction process. I really just need someone who really knows what the current laws are to explain how these things usually go down and help me understand my rights and responsibilities. I am in dire financial stress presently trying to recover from an assault two yrs ago that has left me very unwell. My husband & I also have three kids aged 3-11 attending school and we'd really like them to finish the year here. Please help me make an informed decision. Should I bother pay us through the month? Or should I save what little money I have to put towards getting set up in the next place? I live in a CArental home, owner losing home, in default, sent us certified ltr, how long do we have to mov? We rent a house in CA and owner has sent certified letter to us stating he is losing the home and that we must move soon. The home was recorded in default by the county on Febuary 10th, 2009? Do we have 90 days from that date, and does the bank who takes back the home after the 90 day notice have to notice us to move or is the certified letter the owner gave us our official notice? Or do we have to be noticed by new owners if the property is sold at auction? We need to know a date and are trying to save money as long as we can since the owner now told us not to pay anymore rent. Also, do you think we will we be offered the Cash for Keys and by whom?
Our home is going up for auction? We have been in our home for 3 years, its an older house that we fixed up and put lots of money in to it!! The bank raised our payment up to $500 dollars more each month which already our payment is alot. The house is going to sell on auction in 4 days im not sure what happens after the auction will the house sell? Do we owe our realtor any money if the short sale failed and we bought the home at the auction? We were working with an agent to get the home as a short sale but it failed. We found and hired a bidding service to represent us at the trustee sale and we won the home. My parents paid cash for the home and we are now buying the home from them as a "for sale by owner". We paid the bidding service $1500 for helping us. Now our agent is asking us to pay $2800 for helping us get the property. We didn't sign any contracts with the agent and don't want to pay the $2800 since we already had to pay the bidding service. We don't want to cheat anyone out of their money if it is due though. Please help!
help getting security deposit back after the landlord lost the home to foreclosure? the home was sold on July 27th at an auction and that is the day we moved out. we returned our keys and sent a letter explaining where to send our deposit on that day. the 21 days has now passed and we did not recieve the deposit or a required deductions list. the landlord did not even give us the required inspection prior to moveout. we are going to take him to small claims and sue, i think we have a very valid bad faith claim as well, to ask for double the deposit. i have been reading about california civil code section 1950.5 which covers this, but i was wondering if anyone has any suggestions, have had similar experiences, or know of any relevant prior cases that i can use in our defense. thanks

I'm so upset, he has been taking our rent for months now and did not tell us about the foreclosures. He wants to move in here since this home will be the last to go. He had someone put eviction papers on our door, and it was not a deputy. 3day notice to vacate. Can he evict us and be going thru a foreclusure also? he owes 345.000K on the house, it will be auctioned off in Feb. Can he do this?
Renting House that got notice of Auction? We received a notice of auction back at the end of June and the landlord said he was refinancing and not to worry about it, but according to some of the foreclosure websites its still up for auction 9/16. I'm going to call the courthouse Monday morning to verify if the house is still up for auction (hopefully they can tell me), but I'm curious if and when they will come in the home to tell us to vacate the premises?
No one told us the house we rent from is up for auction!!? So, me and my family rent out the upstairs of this house (it's an old school house in a very small very rural town). We've lived here since July of 2010 and there is NO lease. The landlord has always been okay, she's a bit odd but not too bad. This morning while at the bus stop,..... one of my children's friend's Mother says to me, "oh I'm sorry to hear about the house". I said, very curious, "what about it?" Well, she says, "about that it's being up for Auction on the 25th of this month. " I was shocked! I said, "um excuse me"? She felt bad and immediately said " oh well, maybe I'm mistaken, I mean I'm sure your landlord would have told you". "yeah let's hope so I said back." So, naturally I went home, looked it up online and found nothing. Later on I went to the library and asked the librarian if she heard anything about it (the house is a landmark and is well known). She said yes in the paper.... then showed me the picture and address of our house!! (well you know what I mean). I'm a bit upset as I don't know what this means for us. I mean we have 2 young kids!! It's not exactly easy to find an apt. on such short notice.... we have a houseful of stuff too to pack!! Has anyone heard of stuff like this? Is this right? What happens if it doesn't auction ??
Hi, Can anyone help us with hard money loan or private investor loan? My husband and I are currently in foreclosure with an auction date set for this week. We need $10,000.00 to save our home, this include past payments and attorney fees. Due to me having surgery and my husband being in a wreck along with other past obstacles with are now faced with losing our home. We have tried to get refinanced but to no avail. Yes we have the poorest of credit rating but we are constantly praying that some how and some way God will touch someone to help us. If someone would be willing to help us, we would show our appreciation and gratitude by making payments on time. We are honest people who praise God from whom all blessings flow and are not trying to scam anyone. Thanks in advance for your help!!

Ok well im not buying a home literally, but im looking for one, for my wife and i, right now its impossible for us to buy a home, because i dont work, although our credit is good, close to excellent actually, i just want to know with too much jargon, what is actually involved in buying a house, i understand about bank mortgages and good rates, approval, pre approval etc. But, what should i look for in buying a home, in terms of foreclosed homes, auctions etc, im looking for a home where it doesnt have to be in perfect condition, but i dont want it to fall down in 10 years time,where should i be looking for that? also as far as realtors, inspectors, surveyors go, what is there job?, are they nessesary when buying a home? Im a first time home buyer,(well will be) so any other info i can be given that i haven mentions im probably not aware about so i be grateful for all your advise and experiences, Thankyou! rowlfe, i like to think i use language to what everybody understands, not just "great succeeders" like yourself, therefore, i expect it in return , not for me, but for others who may later on check this question out, for someone with such standards, you did just talk a whole lot of nothing, a basic question/s needs basic answer/s, in basic english. Does anyone else feel that this companies glorification of the sale / auction of peoples repossessed homes is in really bad taste given the countries current financial situation..? How much money do we really need to buy foreclosures before or at auction? We are would be first time investors in real estate and have been studying up the various stages of foreclosure and the ways to buy. We thought we had enough to buy one property for us, and another as an investment, but having learned more about this market generally, and wanting to keep away from the lower priced, lots of repairs options, we are starting to get concerned about our ability to fund this grand plan. We will be able to get a line of credit on the home we would buy as a residence though. What other options have we got when we haven't time to raise a mortgage to close a deal?
Do we have to pay the 3% commission to our buyer's agent if we bought our home at a sheriff's auction? We signed a buyer's agreement with an agent. He showed us houses on three occasions. We went to a sheriff's auction and bought a house. I remember him talking about at least $150.00, but I don't remember what the contract says and he didn't give me a copy. Do we have to pay him 3% or can we bargain down that price? Here's what the contract states: "I agree to pay Real Living HER a fee equal to three percent of the sale price if I, or any other person acting on my behalf, purchase property during the term hereof (and any extensions) where Real Living HER is unable to cooperate with other agents/brokers to receive an/or negotiate a fee to be paid by the Selloer or the Seller's sales associate. I agree to pay one hundred forty nine dollars compensation to Real Living HER at the closing in consideration of administrative services provided by Real Living HER."
A life on the auction block? A Life On The "Auction Block?" My stepbrother (executor of my mother's estate) expects my sister and me to BUY items from our deceased mother's kitchen if we want to take them home with us. So that means if I want her collection of small spatulas and whisks I have to BUY them from the estate. Is that extreme or what? I can see selling the house, furniture and appliances to help support my step-father, but well used kitchen gadgets? Any thoughts out there in Answers land?
What should we do about a tenant who refuses to leave? California We just purchased a property (a home) through auction and there is a tenant living on the premises. To my knowledge, when we acquired the property, any lease the tenant had was terminated (I am not sure about this). We asked the tenant if he wished to stay, making a new lease with us. The tenant has refused to give us an answer and seems intent on staying on the premises without paying rent. What can we do? Can we file for unlawful detainer immediately?
Anyone know about renters rights in result of a home forclosure? My husband and I are renting a townhome from a realty company. We have been here for 5 months and signed a 1 year lease. We were recently informed that the owner (investor) which we have never met defaulted on the loan and the home is being forclosed on. The rental company told us we could move into another townhome. I'm irritated because now we have to move, even though we have paid our rent. Should the rental company pay for the expenses for us to move? We have inquired about purchasing the home at auction and were told we must pay the closing costs. We don't have that type of cash and just wanted to add it into the loan but were told by the broker that we cannot do that in a forclosure. I just wanted input because we are not experienced with this. Thank you.
How do I get e-mail addresses for some of the Country Music Artist, we need donations for an auction in march. I work at a home for the developmentaly disabled - 96 men to be exact. We have an annual auction to raise money to help with the up keep of our building and to do various remodeling projects. Our "wish" list is growing, so we have decided to contact the Country Music industry to help with some donations. Toby Keith has already donated for our auction, as we have promises from a few others. These are an amazing group of guys to work with. If some of you know of ANY star we can contact for our auction it would be greatly appreciated. Last year I tried the "talk show people" and got NOTHING from them. Anyone who knows how it is when you depend on funds from the state, know how the funds do not go very far at all! Auction date is here.. now what ? I reside in the state of Florida. Hillsbrough County. Last week we found out the house we are renting was being forclosed on. The Auction Date of 08/02/10 came and went. We kept our rent money this month in our savings. A Man passed by to look at the home as he said he found out that home was being foreclosed on online and wanted to look at it before placing a bid. He left his bussiness card. I called him on the 2nd in the evening. He said the bidding price was too high and no one bid on the home. He informed us the home is now owned on the bank. My Question is what should I expect to happen next ? Will the bank come evict us ? Will they give us time to leave ? Should I be paying my rent to the bank ? Should I contact the bank or wait till they contact us ? I just don't want to come home and find my things on the street. Has anyone else been through this, some insight would be great ... :) Any help would be great! Thanks
In the state of California can a credit card company who places a lien on a home force you to sell your house? My mom is the primary owner while I'm the cosigner/owner. A credit card company is about to go to court against my mom. Unfortunately she lost her job and has been unable to find any other employment so she does not have wages to garnish. All she has is a small pension check (approx $124.00) she gets monthly. I'm thinking they may end up placing a lien on our home. Previously I was given the impression a lien just meant they can collect if we sell the house or refinance. Now I'm hearing that they can actually make us sell our home or put it up for auction. If they did, we have no place to go and would be left homeless. It's hard for me to pay on her debts because I have my own I'm paying (I'm trying to avoid wage garnishes) along with all other household bills. I don't want to lose our home due to a credit card company but it sounds we possibly could. I was wondering if anyone knew what the lien laws were for the state of California or had a similar experience they could share.
what will be my liabilities on home being foreclosed in las vegas? my home is going into foreclosure in las vegas. this isnt my primary home we tried to short sell had an offer the the bank accepted but the mortgage insurance company didnt accept it and wouldnt release the house. they wanted a promissary note that was too much for us so we offered them less and they didnt accept. even the negotiator at countrwide couldnt understand why they would accept it because countrywide feels they can only get 200-220k for home in auction and the offer we had was 259k. the insurance company will have to pay countrywide regardless if its short sold or foreclosed on. they could have short sold it for more money than they will get in foreclosure so they would have to pay less and plus they would have gotten our offer. now we are not giving them anything and there liability will be more since the home will probably sell for less. My question is will anyone come after us for money? alot of people tell me they wont because it cost too much.
Having problems dealing with a bankruptcy truste in purchasing a home back...? she agreed on a price and entereted a order with the court to sell us the home for that amount it took us longer then she wanted to close on the home but now we have the money but she refuses to close now saying she will just auction it off... any ideas on how to stop her and get her to honor her agreement.... there was no time frame on the order and the truste was the one that entered it. and the truste will not talk to us at all and she's is insisting on having a auction and selling the house the time frame was somithing she set herself that wasn't realstic but it was NO PART of the order it just states she is selling the house back to us...for a set price...
How long for completion date/move? My partner and I sold our home @ auction a couple of days ago. We're also buying a property which has is vacant possession. Our Real Estate Agent took $21,000 & Our home! Please Help? We (thought) purchased a home in 2007. Our credit was a not bad but not enough to qualify for a home loan. The realtor agent offered to take the $21,000.00 down payment, apply it to the purchase and keep the mortgage papers in her name until we qualified and could put the mortgage in our names. Until then she we were to have, papers signed and notarized giving us legal rights. There was always an excuse to not to sign and notarize any paperwork showing us having any legal right. She never authorized us at the bank to have any contact with them for any reason allowing us access or communication with the lender. Even if we wanted to make a payment online or by phone, we could not due to not being authorized. Now two years later after paying the mortgage she told us she gave the house back to the bank and bank will no longer accept a check from us to pay the mortgage. Tomorrow it goes up for a trustee sale the only proof we have is the $ 21,000.00 payment made to the mortgage co. in the form of a money order. And cancelled checks and debits out of the bank account for the monthly mtg. There was no rental contract or lease agreement because of course we thought it was our home. What if anything can, we do and what happens to us after the auction sale tomorrow? How long do we have to vacate? She also has all our escrow paperwork from the sale of a piece of commercial property we sold in October of 2007, which gave her a very large commission, and will not give it to us. This keeps us from filing our 2007 tax return because we do not have the information of the sale. In correspondence the IRS sent us, it shows that for the sale of our commercial property, the escrow company listed her home address with our name as our mailing address to send correspondences and/or paperwork . When we call her, she just hangs up on us. Please advice.

HOA - Home Owner's Association? I asked this over the weekend but I did not get any replies so I am asking again. This might be lengthy but so is the problem. I am on the Board of a Home Owner s Association. Long story relatively short....We get an update every month on the status of everyone's HOA dues. This month I was looking thru the report and inquired about someone that owed 1800 dollars. The HOA rep replied back and said we have owned it (HOA ) since 5 August...this was Thursday am. We were never informed. I called the courthouse and it is still in the previous owner s name but the house is vacant. We are told it defaulted to us when it went to auction and no one bid. We even called the city 2 weeks ago because the grass was 2 feet high. So we called the city on ourselves. We cannot get a clear answer from the HOA regarding the legal ownership. 2nd problem Another house we inquired about owed 1k plus because they did not pay their dues. We tell people it is going to the courthouse for auction as a threat but they always follow thru with payment. Anyhow, according to court dockets it was auctioned off for $100 on 5 June and we have owned it since then. The HOA management company and the lawyer working for them did not tell us. We learned this on Thursday as well. So we have owned this house since June and were not aware of it. The previous owners are still living in the home, even though court dockets list the HOA as the owners . I do not know why the mortgage holder did not claim it but our name is on the courthouse records and the county tax appraisal docs. 3rd problem Another man owes 1774. He agreed to pay 300 a month over 6 months and did not pay for 2 months straight and paid 132 last week. The first payment in 3 months. The HOA rep seems to think this is ok even though the 6 month repayment is the standard and what we apply to everyone else. 4th problem We tried to collect 1800 from another man. Been trying since April. The last payment he made was in Feb of 2007. We had a date for the house to go to auction on 2 July for nonpayment. On 27 June he agreed to pay 25 percent down and the remainder over 6 months. Just like everyone else. Then he hired a lawyer . His lawyer and ours have been talking and our lawyer insists that we settle for 1300. Even though this is against our standard and in direct violation of our terms. And he had already agreed to pay the full amount. He has enough money to pay for a lawyer but not enough to pay his HOA dues. The HOA would have to absorb the additional 500 dollars. Question: Do we have a legitimate case against our lawyer and HOA rep ? Or should we just try to muddle thru the ownership issues and get past it ? I and others feel we have been betrayed and the lawyer has not been representing our interests and our HOA rep has been negligent. I mean how can they not inform us that we own 2 homes and not explain the ownership procedures ? Also...we live in the Northern Texas..ground zero for natural gas drilling.Both homes we are suppose to own were issued gas lease bonues since these ownership issues arised..about 4k for each home that should have gone to the HOA instead of the previous owners. So the HOA is out of 8k. And one of the 2 men listed above got his 4k bonus money 2 weeks ago...but he still will not pay his HOA dues. Should we get a lawyer ? Our work thru it ? Our HOA is meeting tonight - Monday - to discuss it.

Now Tracy Orr can return to her Pottsboro home, making payments to the woman who unexpectedly and impulsively bought it for her. "It means so much to all of us," Orr told Dallas television station WFAA. "It's not just a house." Marilyn Mock said she was acting on instinct on Saturday when she decided to buy a house she had never seen for a woman she had never met. Mock was at the foreclosure auction to help her 27-year-old son bid on a house when she struck up a conversation with Orr, who was crying about losing her home. Orr had bought the house for $80,000 in 2004 but fell behind on the payments. She lost her job a month after taking out the loan, and earlier this year she lost the house. On the spot, Mock decided to buy it, eventually bidding $30,000. "She didn't even know if I had a job or was a nut case," Orr said in a story for Wednesday's online edition of The Dallas Morning News. "She didn't even see a picture of the house." Mock told a crying Orr she could stay in the house, making payments to her instead of a bank. "She needed help. That was it," Mock told the newspaper. "I just happened to be there and anybody else would have done the same thing." Orr said she hopes others will do as Mock did. "More than my house, she gave me something inside, and that's more important than material or financial things," she said. The two are waiting on final approval from Fannie Mae before visiting the home. Mock's son also got a home at the auction.
I am renting a home in foreclosure from w/ no lease in AZ. How many days will I have to vacate when it sells? My boyfriend and I recently moved into a home in Arizona that is in the middle of foreclosure. It has been up to auction sale several times and the sale date is constantly pushed out. We do not have a lease and the landlord wants to be paid in cash only. We rented the home because it was such a great deal and we are trying to save $. Once the home is sold when will we have to vacate the premises? Due to us renting the home but with out a lease I am concerned how much time we will have to vacate. (i understand, we're not the owner) we have 4 kids and I just want to know what to expect... we rec'd notice 3 wks ago and landlord will not answer calls. Home in foreclosure (I think).? I rec'd a letter from an attorney for my 1st mortgage co (80/20 loan) saying they were going to foreclose on my home. This came as a surprise to me; I contacted the mortgage co asking for some type of loan modification and didn't receive a reply. I checked; in my state the attorney has to mail me a certified mailing, signature required foreclosure deed at least 30 days before putting the 1st ad in the paper advertising a foreclosure auction on my home. They have to place 3 consecutive ads at least 21 days before the auction, so from the certified letter to date of auction is at least 51 days. No one was home to sign for the certified mailing and it was never delivered. I notified their attorney (before I realized the importance of that mailing) that we had not rec'd it and to please redeliver. They ignored me. In the meantime, I continued to try to contact the mortgage co. Our phones don't work consistently so I was mailing faxing and USPS mailing them (incl Delivery Confirmation) and they didn't reply to any of my attempts - at least 7 letters - except with 2 exact same form letters saying "We need more information, please call or fax us". Even though they didnt ask for it, I figured they'd want a letter of hardship and income info so I faxed and mailed them the letter along with paystubs and an income statement. No reply. Meanwhile I never rec'd that certified mailing so I started to think the mortgage co halted foreclosure as they could see I was sending them materials trying to work something out. I checked local papers every day and could not find any auction ad. Then the day of the supposed auction came and people showed up. No one got out of their cars and everyone was gone in 10 minutes. No one talked to one another so I don't know what on earth happened. I was prepared to go out and intercede since according to the laws in my state the auction would be invalid as I never received the certified mailing or saw the auction ad(s). As the homeowner I have every right to bid on my own property but I wasn't given the option because up until that day I didn't even know if it was happening or not! About an hour after the auction I received a fax from an actual person at the mortgage co saying they wanted my phone # to work on my case...I notified them AGAIN that I don't have a working phone. That's been it. So now I have no idea what's going on. I'm 8+ months pregnant with my 4th child. I've notified the mortgage co of this and they apparently don't give a rat's a** and can't be bothered to let me know if they are doing something or if they halted foreclosure as I requested or what. Right now I'm in total limbo. What do I do? Every real estate person I've talked to is more than happy to assist me in short-sale, every lawyer wants to help me file chapter 13....but I want to keep my house!!!! Are there any mortgage negotiators that are legit and yield results for people out in yahoo land? I just don't know where to turn...I feel like no one has my best interests in mind and are only interested in making money off me one way or another. What do I do? It can't be legal or ethical for these people to operate like this and keep people totally in the dark! A. Don't pretend to know anything about me. I have been making monthly mortgage payments which is why this is a suprise. I sent them over $1400 days before I rec'd the atty letter. I've contacted them in the past and was told they would put the past-due amount on the back end of the mortgage and that was it, then a few months later my statements are showing a balance due and a past due balance in the thousands. I've talked to several people there in the past at various points that cant keep track of anything their fellow associates setup. B.) I did not "refuse" the mailing whatsoever. I signed the green card USPS left that it could be left at my home. USPS took the green card and never left the mailing. The law verbatim: "No notice shall be valid or effective unless the mortgagor has been mailed written notice of the time and place of sale by certified mail return receipt requested at the address of the real estate...at least thirty (30) days for individual consumer mortgagors
How long till we must vacate our foreclosed home in Phoenix, AZ that sold at auction just over a week ago? Our home in Phoenix, AZ was foreclosed and auctioned off to an investors group recently. The representatives that have come to speak to us initially said we could "sit tight" here for a little bit while the group contemplated what they were gonna do with the property yet if we were interested in staying in the home, they would accept us as tenants at the current market rental value for our area. They told us a few days later that the owners have decided they'd prefer to have us leave as soon as possible so they can get started with refreshing the property and reselling it instead and would be willing to let us sign a lease and pay for through the rest of this month, or help us contact salvation army or whatever community aid program to perhaps help us make the transition. Otherwise, they'll have to begin the eviction process. I really just need someone who really knows what the current laws are to explain how these things usually go down and help me understand my rights and responsibilities. I am in dire financial stress presently trying to recover from an assault two yrs ago that has left me very unwell. My husband & I also have three kids aged 3-11 attending school and we'd really like them to finish the year here. Please help me make an informed decision. Should I bother pay us through the month? Or should I save what little money I have to put towards getting set up in the next place? How does the first time home buyer tax credit work? Do you know about the first time home buyer tax credit? How does it work? Will I get that 8,000 credit back in my taxes in the following year? Would my sister and I qualify? I have never owned a home before and my credit fico is fairly good at 765. I have a credit line of 30,000 and only 5k debt. My sister on the other hand has about 40k debt in loans and has owned a home within the last three years. Her credit is lower than mine but she makes nearly a six figure income. I know if we buy a house together we will not exceed the 150k limit requirement to qualify for first time home owner tax credit since my income does not exceed 50k but would the fact that she has owned a home recently disqualify us from the tax credit or would me being a first time home buyer fulfill the requirement regardless that she has owned a home recently if we buy together? Would it be advisable that I purchase the home in my name if she will not qualify and just transfer her into the deed and mortgage at a later time once the tax credit is received in the next tax year? Also, in regards to foreclosures through auctions do you think they are a good idea? Do you deal with foreclosures auctions? I know a home can be obtained for much less than market value via these means.
What will happen now my landlord lost house to foreclosure? My landlord went to foreclosure without evicting us. The bank tried to auction the house today, but got no bids. The title reverted to the bank. What can I expect to happen next? I worry about coming home to find the locks changed, all our stuff seized. The landlord won't take any calls and hasn't for a month. What about our security deposit? Don't I have to be given an eviction notice, or am I just out of luck?
the home I rent is going in foreclosure. The sale date is in Aug, do I still pay rent? The person I am renting from is letting 15 units go into foreclosure. He did not give the courtesy to let us know they are going in to foreclosure. He is still asking for rent even though the property is going up for auction in aug. I need to find a place to stay, and I doubt that he will give us our deposit back. Should I continue to pay rent? CA Real Estate - If you are in foreclosure, what are the benefits to Short selling your home? Believe me I know this is a long shot but I am considering trying to contact homeowners who are in Pre-Foreclosure in attempt to try and find a good deal on a home for my family. We are approved for a loan but keep getting beat out by cash offers. We do have a Realtor, we are willing to close quickly, and we are willing to overlook certain defects in order to keep our family in the town that we love. I was wondering if there are any advantages for someone who is in Pre Foreclosure, Foreclosure, etc. to try to get out ahead of the home being sold at auction so long as they have no hopes of a loan modification or other salvation. What are the pitfalls for us? Any tips on how to get the bank to accept a short sale price? Please no rude answers. I really don't know that I can bring myself to contact people in this situation, particularly people that I know being that we are trying to stay in the same town. I am simply exploring all options that I can think of since a conventional "place an offer, wait for acceptance" is not working right now.
We got an eviction notice on my mom's birthday! PLEASE HELP!? so yesterday, was my mom's birthday . we got an eviction letter last night and we think it's been up there for a while . we were in shock because we hired a foreclosure lawyer that would help us communicate with our lenders better . my dad sent her all the paperwork (bank statements, etc) about 3 weeks ago so she could send them to our lenders . she said everything was going to be OK and that they received the paperwork . now we have no idea what happened and our lawyer isn't calling us back to tell us what went wrong . additional details; -stopped paying mortgage 6 months ago . -got our first notice about 4 months ago (then we hired a lawyer) . -guy stopped buy our house 2 days ago telling us out home was for auction, but my dad told them we were in the process of getting a loan modification, so he went away . -we didn't want to short sell the home because we put so much effort into it . -i think our monthly payments were about 5k . -we live in California . -family of 5 . (mom, dad, me, 2 younger bros [4 & 7]) -the paper said 3 days, but we read online that we actually had 40-60 days . ---->What i want to know is how we can reverse this, how much time we really have & what we did wrong to get this .

Foreclosure in KY with US Bank "Cash For Keys" ?? My home was put up for auction this past Tuesday due to foreclosure. My family is still living in this home. And it sold back to bank at auction. I was told by the Legal Aide off here in KY that I can ask the bank to do Cash for Keys. Has anyone ever done this before? With US Bank? In KY? How do I go about doing something like this? can a repossession 3 years ago keep you from getting a FHA loan? My husband and I are trying to buy our first home..well three years ago we relinquished his rights to a truck little did we know that it would show as a repossession on his credit score. We paid off the remaining balance of the truck after they sold it at auction. Since then we have built his credit score back up to a 688 and mine is a 733. Will this stop us from getting a FHA home loan?
need quick brain induced strategies for private auction between 2 persons? A beneficiary is maybe forcing a clause in a will to be used to determine who gets what from the contents of the home. As it is understood, each person takes turn bidding on item #1, etc. The high bidder gets that item. Once all items are sold with play money, the person who bid the greatest total, say $10,000 would pay the estate 1/2 of the difference between their $10,000 in bids compared to the other bidder's total of say $8000. They'd pay the $2000 difference, but since they are a co-beneficiary they'd get half of the cash back. One issue is how to decide which items are auctioned 1st, 2nd etc. There are very high dollar items from a $2300 book case, $1600 oak dining table, both original cost, down to a microwave. I'm one of the two, and looking for strategies on how to bid to get what I want and to drop (the items my sister wants), on her, at the highest price. We both already know what we want but this auction will put both of us in a bind. Is my sister's bid a bluff? How high should I go? etc. NEED strategies, her lawyer is pushing this auction soon. One idea was to agree to let the person who wants an item to bid, and the other person just say I decline to bid, and thus everyone gets what they want. This could be a court ordered auction since the will has it as an alternative plan in case of disagreement over contents. There are minor disagreements on contents but major conflicts on other parts of the estate. 99% of that is sequence of events (signing of deed, contents, accounts - one personal rep is making the rules and demanding deed signed last) Any auction bidding pros in here? There is a 100 year old oil painting we know it has a value of $250. I do not want it and my sister does. How high for me to bid to drop it on her at a high cost? On who gets what we agree 90-95%. My sister is not inheriting any of the house, but she must sign the deed over. She refuses (until all her contents on are a truck and safe, but legally she does not have to sign the deed until next July), so I am, using the only bargaining power I have, refusing to agree on dividing contents. The will says if we can not agree, then this play money auction would be held. She does not want the auction. Total contents is worth about $22,000. House $153,000. She could hold back the deed for 10 months if I agree to divide and release her contents. This is why the auction is suggested by her lawyer.
Home financing help needed? It's been a miserable holiday so far, Friday we found out that the programs that I qualified for do not exist anymore for me. They have changed the qualifications, now I am short on funds for financing by $3,000.00, and there is no where to borrow it from. One of our Kitties passed away Sunday. My Mother is already stone drunk and I am suppose to go there for dinner. My boyfriend went to go see his family 20 miles away for dinner. We by-passed Christmas because of the "House" that was suppose to be a done deal...our Christmas to us...LOL Any ideas for new home financing? It needs to be closed per contract by 01/04/08 or it goes to auction...it is in the final end of forclosure. I will contact you tomorrow. Said it was an FHA? How can I find my auction date for my foreclosure in California? My home went into foreclosure on 12/6/07. I live in Stockton, CA San Jouquin County. I have called the bank who has the loan and they weren't able to give me any information about the auction date. I am aware that a letter should be sent out to us 20 or so days before the auction. But, I would like to know when that might be? 1 day from now, 2 months, 5 months etc? Does anyone know who I can call to find out some helpful information regarding this? I would like to stay here as long as I can and continue to save money and pay off exsisting bills. Thank you all for your help.
Horse auction questions? My friends and I are going to a horse auction this summer to rescue two horse.Don't worry we all ride hunter/jumper and show on the "a" circuit and know how to handle a horse with they get frisky so were basically all advanced riders. Anyway this is a first time rescuing horses from auctions and I have a few questions about auctions: 1. Will the ex-owner tell us how well the horse trailers? I was served papers for my landlord who lives upstairs, for a foreclosure back in Dec. we talked to her about it, and she said that she is working it all out, and not to worry. I came home on Wednesday the 22nd of Apr. and there was a huge Sheriffs Auctions Sale notice posted to the front door. I again went up and talked to her because I don't want to be locked out of my apartment or lose my belongings because of her mishap. She again told me don't worry about it that the mortgage company she is working with tells her that everything is ok don't worry about the notice. I looked it up on the internet and it is posted for Auction. I walked away feeling like she was lying to me because in her next breath she said her husband would be home on Friday the 24th and not to say anything to him about it. (hes been in boot camp since Jan.) We spoke to her on Sunday and told her that we were looking for a new apartment and she was like..."well, if that's how you feel about it" and has been ignoring us ever since. We have found a new apartment and are planning on moving in May 15th. We ran into her husband and he asked what were we doing spring cleaning, and we told him no that we are moving and planning on doing it the 15th of May. Needless to say she never said anything to him about us moving out. Here is my issue she has a $400 deposit of mine, I don't want to pay my rent for May since my (month to month) lease is up on the 5th and we are moving on the 15th. I feel because she hasn't been honest with us she is forcing us to take on this financial burden of having to come up with more money for a new deposit and 1st months rent...Which we really don't have. My plan is to let her keep the deposit of $400 and that will be the rent for the 10 days we will be there. So since she is avoiding us like the plague, and we don't see her I have to write a letter to her. I am not concerned about being put on the do not rent list. Im common law married in the state of Texas with 2 kids and my husband has supported us for the past 5 years? I live in Texas and my common law husband and I have a failing marraige and 2 children. We own a livestock auction barn a home worth 375,000, and multiple vehicles, including a suburban that is owned free and clear (everything else has bank notes) I do not work and help my husband do advertising for his business, my kids are in full time daycare, which he has paid for, for the past 2 years. I have my real estate license but with the market being what it is I in activiated it due to the fact that there are dues and expenses associated with it. I have been staying with my sister and her 2 kids along with my 2 kids for the past four days. I have no bank accounts and no money, what should I do. Left because we constantly fight about everything. He wants sex, we have not kissed on the lips in over a year, (not romance or making love) I want him to answere me when I ask a question. My sister is very dis functional as well but she dosent threaten to kill me. My home is 3000 sq. ft. How do I quell my husband's anxieties about a home we're buying? My husband and I just signed a contract to purchase a 1600 square foot ranch style home on 1 acre of land in the hills north of Huntsville, AL for $105,000. The house is very well kept and only needs minor cosmetic repairs that mainly consist of new carpet and paint in the bedrooms and formal living room. Other than some outdated kitchen appliances the house is in great shape. The seller is a landscaper so the property also has a beautiful front and back yard. The sellers also have done significant cosmetic work to the kitchen, family room and dining room. I'm talking new laminate floors, ceramic tile, paint, lighting fixtures, counter tops and more. The house also has a fantastic view of the mountains in the distance. We live out in the sticks so we only have one neighbor next to us. My husband is nervous because his parents (mainly his mom) keep telling him that we "over paid" for the house. They live in Delaware (where we just moved from) and their excuse is that a few years before the housing boom they managed to buy 21 acres of old logging land for $50,000 at a tax auction; where they built a 2000 square foot 2 story home for an additional $125,000. The truth is, the old logging land was expensive to grade and required a variance from the local authorities to put in the septic tank. They inadvertently hired one of those mass-production type contractors who slaps up houses with the cheapest of materials so at 6 years old their house is basically falling apart around them. The home we're buying was built sometime in the mid-eighties and feels very sturdy. My dad worked in the residential construction industry for over 30 years (mainly doing high end remodels on older homes) and thinks this house is a good buy for the price. He taught me how to spot potential trouble areas in homes when I was a teenager so its not like I'm a total moron when it comes to home buying. I'm having the home inspected tomorrow anyway so if there is anything major we won't get stuck with it, per our contract. My mother-in-law convinced my husband that we were also getting a bad deal because the house is selling for $105,000 but is estimated to be appraised at $115,000 to $120,000 (it was originally listed for $130,000, last year). She says "its not enough of a discount in this market". What she fails to realize is that there really wasn't much of a boom or even a bust in the area we're in. Home prices only increased slightly faster than the normal rate for the area and haven't taken much of a dive since the bust. All she's doing is making my husband upset about our first home purchase. She also has this crazy idea that we "need" a lot 5 acres or bigger for our first purchase. Honestly, we would not be able to afford a house as nice as the one we're buying with a lot that size. I'm not comfortable taking on a $900+ a month mortgage at 22 years old. We're going through a several state sponsored first time home buyer programs (USDA Rural Development Mortgage, Step-Up and Mortgage Credit Certificate program) in our state that will keep our mortgage at around $650 a month. Which is only $30 more than our current rent. How do I get my mother-in-law to understand that our situation is totally different than hers. My father-in-law had just retired from the Air Force after 20 years when they bought their first house. I'm 22 and my husband is 25 and we're buying for the first time, a totally different ball game.
Is it legal to hold an auction on a property you sold three days before the scheduled auction date? My husband and I are buying a home. The estimated closing date was September 1st, but it has been moved up to the 28th of August. We have been driving by the house and noticed that there is still a ton of stuff in it. Then I got a call from a friend of mine telling me that she saw a flyer advertising an auction that is being held at the house we are buying, on August 31st!! How can that be since we are moving into it on the 29th and 30th?! Is it legal? Can I stop the previous owner from doing this? When we go in to "close" the house will be OURS, right? It's not like she can keep the keys and not give them to us until the 1st right? She agreed to the earlier closing date so I am really confused as to why she planned it like this. Please help!! Just to clarify, the auction is to sell some of the previous owners stuff, not the house. We are using an attorney and the seller is selling her house to us through a realtor. No earnest money was put down, and we live in a very small town so we are confident that it is not a scam.... we know who the lady is and all that business, which kind of makes me more mad that she's doing this!
Me and my husband are renting a home, and about a 3 mths ago a lady came by and said that the property was....? Basically the property was going under foreclosure. Immediately I contacted my owner and questioned him about what was going on. Husband and I are trying to buy a home? My husband and i looked at a home last Thursday and we signed and made the offer on Friday and then of course saturday and sunday the banks were closed. Now this is a foreclosure and a AS-IS home and we are ok with that and the house has been on the marked as of 09-28-2008 with no offers nor contracts that is what the banks that has it told our real estate agent Monday. Foreclosure in California. My house is in the foreclosure process.? My question is, once the lender sells the my home in an auction, are the lenders required to give us a certain amount of days notice for us to move out? Or will they just come and lock up my house? I know a couple of years ago lenders had the right to come and lock up the house even with your stuff still in it without notice. But with the market today, I need to know if they will give some type of notice? And if it is required for them to do so?
Are all the REO family homes older and really scruffy? We are looking for a home in Florida, wanting to see out our retirement there, thinking of around Fort Lauderdale. Meanwhile have been trying to educate ourselves a little here in Colorado Springs by having an initial look around at auctions and REO suggested by a local agent. Question/Advice about a home loan?? Can you still get a home loan if you have a reposessed car on your credit even though you are paying on it? A friend of mine got a job offer in another state & is going to sell his house but would prefer to sell it to friends. He told me & 2 friends of ours that we have dibs on it if we want (cause we really like it!) but they are married & have a reposessed car on their credit right now. It was auctioned off below the original price so they have to pay the difference & are slowly paying on it..........can we still get a home loan & would there be better chances at getting one if they have me included on it? I have really good credit. (Paid off a car in my name in 2 1/2 years & never missed a payment on it or anything else.) We are all in our 20s, STILL living w/ parents right now & are desperate to move out & live our own lives before they drive us nuts!!!!!!! What recourse is there against a person that foreclosed on an investment property then re-bought it at auction? The person that owns the house behind me, who also happens to be a real estate agent bought the house as a spec/investment. When the market crashed she had a difficult time unloading it. It has been vacant for over a year and has recently been foreclosed on and sold at auction...to her (or a friend of hers)! Now she is renting it out with me and our other neighbors who were responsible in buying our homes, are left with lost equity of over $300K. Not to mention the fact that most of us are now underwater due to irresponsible people such as this woman. Do we have any recourse legal or otherwise?

the bank will not do the short sale on my home and it is recking my credit? almost three month ago we got a cash offer on are house, but it is about 10,000 short the bank keeps jerking us around wait till it goes to auction on dec 17, they must think that the house will go for more than 65,000 In that area they will be lucky if any one show up to bid on it or the fact that most people can't get a loan right now. So when wellsfargo comes after me for the 70,000 can i counter sue them and say they had 65,000 on the table and they dropped the ball. but i can on mine
wrongful foreclosure? They sent us a certified letter saying in "2 weeks your home will be in auction". We contacted the lender and they realized that they were wrong, they said they will give it to the supervisor. We asked them to give us a letter stating that it was a wrongful foreclosure, they said they can't do that. What should we do about this situation personally and legally. How to break the ice ? Hubby and I are aware that we are watching kids for a poor family however they BOTH work and do not have alot to pay for at home. How can we rid ourselves of responsibility for a house we surrendered in bankruptcy that was not foreclosed? In 2005 we filed Chapter 7 and surrendered our home. The lender foreclosed in 2006, and the house was put up for auction by the sheriff, but did not sell (twice). The lender then sold the loan, and the new company tried to force us to make payments, until we told them we had filed bankruptcy. In the meantime we moved out of the house but our lawyer says we must carry homeowners insurance on it and cut the grass, etc. We just want to hand it over to someone!

Years ago my vet told me that a straight alfalfa diet was not good for horses due to high calcium content ...? And that it could cause kidney stones because of it. We bought a mare at auction that was thin and because she was so sweet and very well trained we thought we'd fatten her up and give her a good home. Once we got her home we discovered she was thin because she wasn't eating or drinking. We had our vet out immediately and after a week of trying everything he told us it was most likely calcium stones due to a rich alfalfa diet and that there wasn't anything we could do. Sadly we had to put her down. Recently I answered a question on here saying that I feed a bermuda/alfalfa blend and that this was the reason. A couple of people commented that they had never heard that and seemed to think I was full of it... Now I am wondering if anyone else has ever heard of this or was Dr just trying to find something to explain her condition and came up with it since he didn't have a real answer? Michigan Foreclosure...? My mother-in-law informed my husband and I that she is losing her house. I'll give you the info she gaves us and maybe someone can tell us what can be done? A little over a year ago the home was refinanced (the second time in a little over 5 years) for the full purchase price and equity (a total of a little over 120 grand). She claims that she made a payment plan with the mortgage company (cant say how true that is) and went yesterday to make the first payment according to the plan. The mortgage company told her that in essance it was too late and that the home was/will be auctioned Thursday. Apparently it has been in the paper for this auction for the last month (we knew nothing of this). The mortgage company also told her that she would have to pay $4,000 to stop the auction sale. So if she doesn't come up with this money and the home is sold at auction, how long does she have to stay in the home? Can she try and sell it herself?? Is there still a chance to save the house?
Mortgage question? Hi I am trying to understand how my mortagage/interest rate is all calculated. We purchased our home though an auction, and its owner financed us. Its a little confusing. Anyways, the purchase price was 34,000 w/10% interest 1000.00 down and 375.00 per month on ballon note for 5 years. At the end of the 5 years we wil have 28,000 paid off. And will either have to refi or pay off the remainder or if the owner wants to refin. Im not understanding how the interest is calculated. Is it 10% of each payment we make of 375.00? Or is it 10% of the overall loan amount of 34,000. Interest and all will be approx 50,000. Currently it has been exactly 24 months since we started making our payments, we have made them on time, so Im certain we will get a lower rate. The amortization shows that we have only paid off a little over 3 thousand however when I calculate Im coming up with different figures. Thank you all so much. 2nd mortgage foreclosure after chapter 7? What are the chances of the 2nd mortgage foreclosing on our home since the value of home has decreased and their chances of collecting after auction is none, and if they're thinking of 'deficiency judgement' against us it would not work since we filed chapter 7 and we are totally relieved of our financial responsibilities? We remain current on the 1st. mortgage. Please respond, I dont want to continue to make payments on the 1st if we are expecting a foreclosure from the 2nd anytime soon. Thank you

Question regarding fractional reserve banking? I am confused out of this "they print money out of nothing , and therefor the money never existed in the first place ! " argument. When the Federal Reserve, which I understand is actually composed of different leading banks who own like bonds in it ,I guess?, "prints money out of nothing" and they loan this money to smaller banks to loan out and , let us say the loan is for a home mortgage or a car loan and the loanee defaults, and the bank who lent takes the home or car and auctions it and counts its losses, it still has to pay back the Federal Reserve back, right? I guess simplified version of this question is this : Do the smaller banks who , I guess , borrowed the money from the banks of the Fed, have to repay the Fed if the loan is never paid back or if the asset for the loan is sold off for less at auction. Is the smaller bank still in debt to the Fed? Do they ever default on their loans? Please, help put this confusing rambling into perspective thanks! ALSO DO THESE INDEPENDENT BANKS WHO CONSTITUTE THE FEDERAL RESERVE, DO THEY TAKE ADVANTAGE OF THE ABILITY TO PRINT MONEY? IS THIS FAIR??
Need a short-term, long hour job with good pay! Any ideas? Hello, I am a stay at home mom with 2 kids. My husband works a good job and makes decent money, not a lot and we do not have a lot extra to save or spend. I have about $2000 in credit card debt that I really need to get paid down asap. We had some things come up and it's hard for us to make 3 credit card payments each month. I am trying to find a short term job to do for a few days at a time monthly that could be long days and pay good money. Can anyone think of any? I was thinking of trying an estate sale company or auction house or something. Are there companies that look for as needed only workers very often? Any events? Landlord is loosing house to foreclosure. Moved out this month and he did not do a deposit return walktrhough? So bascially the landlord I had for a year was a mess. Never did repairs or anything like that. Then he tried to sell the home very quick for no apparent reason even though we still had 3 months left on the lease that was for 1 year, so we went to eviction court and won of course. we werent breaking the lease. now that we are moving out, he said was going to do the walkthrough which is required by law no earlier than 2 weeks before move out. It turns out the landlord is in so much debt, the home is going into foreclosure and was auctioned today. I moved out and have paid till the end of the month. He isnt returing calls for the deposit and also was interested in getting the rest of the money for the month since the house was auctioned today. Would i just have to go to small claims with the landlord or does the person who wins the auction just pay us off or how does this work? Sorry its so long.
What does "SOLD TO BENEFICIARY" means? We are in a foreclouser and the auction was set for today and when we came home it said that it was sold to the beneficiary. But we just put in a petition for probate since my mother in law passed away and left the house to us. What are our rights and do they have to give us a evection if we can not stay in the home? our house was in foreclosure, PLEASE READ? It's not in foreclosure anymore. We made a payment plan with our mortgage company and we are no longer in foreclosure. We currently don't owe any property taxes and everything is fine with our Hoa. Yet we still keep receiving letters from lawyers and other places that say 'your house is going to auction so and so date please call us to save your home' WHY ARE WE STILL RECEIVING THESE LETTERS? If our house is no longer in foreclosure according to our mortgage company.
No insurance ticket-ticket dropped-still have a court date? My fiance and I were driving home from an antique auction one night and got pulled over. The car is in my name and so is the insurance. He was driving. They gave him a no insurance ticket because I forgot to put my updated card in the car. We went to the courthouse and showed that I had insurance and it was dropped. That was months ago. Now, suddenly, he gets a letter in the mail demanding he go to court or he'll be put in jail. Wasn't the ticket dropped? We had insurance the entire time. Anyone have any idea what's going on? We keep calling but they won't answer or call us back. He's going to court but I want to know what's going on. Anyone have this happen to them?
