How do I sue someone over an Ebay purchase dispute? I live in the same city as the seller. No product delivere
I bought two Dell 26" LCD TV from him. We met up at a local store and made the exchange. He gave me the TV and I gave him cash. He did provide me with a signed receipt. ( A copy of the auction signed by him) He has also left me feedback saying I have paid him on ebay. I called him back the following day to let him know the TV was acting up and I wanted a refund. HIs policy is money will be returned if item is defective within seven days. I told him the TV was running incredibly hot, the sound had alot of static, it also stank of cigarette smoke. He claimed the item was new and did not have the box just the accessories that come with it. He said he would call me back and hasn't. That was 2 1/2 days ago. The other TV he was going to ship to me from the warehouse. NO TV as of today. This all happened on the 5th of June. I just sent him the email that was sent to me by ebay stating that they were cancelling all his auctions. They are investigating him. What recourse do I have as the buyer?

- All you have to do is file in small claims court!! That should get the job done and your money back Dont hire a lawyer: his cost would be more then what you paid...it wouldnt be worth it! You can do it yourself
- Report him to the local police. You're only option after that is small claims. Next time, use PayPal and you're fully covered.
- Well, my claim thru EBay was remarkable, no problem; let Ebay do their job, you'll be pleased. If your seller stiffs you, it'll be through Ebay that you'll be given all information you need to know, to get your money back. I hope you won't have to go through small claims court because if that seller is a bad guy, you might easy win a judgment, but there will not be any cash for you, normally, the complaint merely going on his credit report, and since it is merely a business dispute you are probably not going to hurt his credit much at all. Plus, you will rue the expense of your dollars to create the suit not to mention the pain of consternation and even more anger. It is hard to collect this kind of money-claim, normally. Give seller plenty of time, sue last, and it does sound like you said the seller is trying to staighten out.
- Too bad about paying him cash, eBay has: eBay Standard Purchase Protection Program- no good if ya use cash- Is the guy waiting for the replacement himself,a drop-shipper kinda reseller..? If you are nervous, do call the police-the sooner the better.....matter-of-fact now is even a good time, they are open 24 hrs daily-ask whomever that answers to speak to a detective-chances are, they are out takin' care of business & you will need to leave details & your number...do it & get started-who knows, they may even know your guy-
- Sounds like this guy had hijacked someone else's account which is a lot more common than you might think. Did the auction list an email address or phone number? If it did then you were probably not even dealing with the person to whom the account was assigned. Contacting the police is likely your only option if this is the case. WK
- Unfortunately, people end up on that site selling goods that are stolen. I have reported and that person still has things on there. If you wanted a good deal and a real warranty, you should go to someone reputable. Just think about the circumstances. You play, you pay. Go to court? You can't even find the guy!
