would like to sue an ebay member who reneged on an auction?
they live in another state. is small claims the best way?

- if you are complaining about a seller, you might be able to use a service called squaretrade. They settle claims for ebay, paypal. If its the buyer, move on, sell it again.
- Since the person is in another state, you will have to get an attorney in the state of residence, etc. You will need to gather all documentation, and have someone serve the lawsuit papers, etc. You may need to travel there if the case is heard there. Heck, its a lot of work and expense, hope the sum you ask for is big enough to justify it. In small claims, even if a judgment is passed in your favor, the guy can simply ignore it. Its your job, then, to get the proper authorities to enforce the judgment. Still a tough task.
- You can not sue a buyer if you never shipped the item. If they reneged before they received the merchandise there is no legal matter.
- Why do you want to sue them when E-Bay and PayPal will help you make yourself whole if you are right. You don't give enough information in order for me to help you. Are you buyer or seller? Was payment made/received? What are the other details? File a complaint with E-Bay and/or PayPal, whichever is appropriate. They will work with you to make things right.
