Our landlord rental homes/personal home have foreclosed. he is trying to evict us so he can move in our home. My kids are in school and he did not tell us about the foreclosures until the appraisal came over to take photos of the home and told us about it being foreclosed. He has not paid mortgage since he had all of the homes. His own personal home has foreclosed. He put a 3dy notice on our door to vacate, we live in the state of CO. I'm so upset, he has been taking our rent for months now and did not tell us about the foreclosures. He wants to move in here since this home will be the last to go. He had someone put eviction papers on our door, and it was not a deputy. 3day notice to vacate. Can he evict us and be going thru a foreclusure also? he owes 345.000K on the house, it will be auctioned off in Feb. Can he do this?

  1. His financial situation is not a concern of yours and is irrelevant to your problem. First of all that 3day notice is NOT an eviction notice. However, a landlord has to do that to start the eviction process. Yes, as long as he is still the owner he can try and evict you.
  2. Most state laws require a 30 day notice for eviction. Take this up with your local police department and start packing so that you can move. If he owns the property and it is in your lease, he can kick you out. Good luck
  3. His financial situation is not relevent to your rental. what is relevent is your lease or rental agreement. What does it say about terminating the rental?
  4. As long as he does the procedure according to the law and status of the county in which the property is located yes he can. He can evict you while going through foreclosure. Legally the property is his until there is a sale, after which the title would transfer to either the lender or someone that purchased the property at the foreclosure sale. The other thing is if you are on a month to month agreement and have no lease then that put him in a better position, as leases have to be honored until they expire or both parties agree that is it in the interest of both parties to break the lease. You should contact a local real estate attorney for any legal matters. He has no obligation to tell you his personal business or what financial condition he is in. Why would you expect him to?   5. He is starting the eviction process, it is up to you if you want an eviction on your record or not. He absolutely can evict you to live in his property himself. It would not make sense for a homeowner to be homeless would it? He can evict you to move himself or a family member in. If you want the eviction on your record you can push it another 30 days or so. You will still owe him the rent, plus the expense of evicting you.
