What happens if you would end your ebay account while bidding on something?

Would the seller have the right to take legal actions or would the second highest bidder become the leading bidder?

1. Why not just cancel your bid then close the account?
2. The second highest bidder would become the leading bidder. The seller might be pissed, but I wouldn't go so far as to take legal action.
