I need to fire a California Coldwell Banker Real Estate broker who refuses to terminate the listing. Help?

One of the more blatant errors this guy made, was to tell a potential buyer (a shill friend of mine) the price of an offer on the table. Again, the broker is supposed to be representing me, the seller, but is telling a stranger over the phone what an offer was (not to mention the offer is $30K less than the list price.) I am not having any luck complaining to the broker's boss. DRE complaints take too long. I need out of this contract NOW!

  1. Try making a sign that say "CROOKS" and walk back and forth in front of the office. They aren't legally required to let you off the hook but probably will if you make them look bad.
  2. File a complaint against your agent and broker with your local Realtor Association (MLS). Have your attorney sent a cancellation notice to the broker and re-list with another RE company depending on your lawyers advice. I would immediately file a small claims case for the maximum amount if the broker doesn't release you from the listing because his agent breeched his fiduciary responsibly by giving out confidential information. Use the suit as a lever to get a full release.
  3. He has violated the Realtors code of Ehtics. Specifically Article 1 and Standard of Practice 1-9, section 3. Point this out to the agent's broker and you'll probably get his attention. realtor.sailor
  4. Your listing agreement is a binding contract. However, a letter from your Lawyer and a complaint to the local Board Of Realtors or Association of Realtors (not the MLS) directed to this Agent and his Boss, may be enough to get them to release you from the contract.
