Do I have a sexual harassment case?

A few days ago i was harassed by a customer that comes to the property everytime we have a auction. Well when he first came onto the property he grabbed my arm a couple of times and i told him please do not touch me..then the second time he touched my chest and I told him to get your hands off of me and a couple that witnessed it stood up for me also. So right after these guy touched my chest...i went to my DM right away and told her this man was just touching my chest. When i told her she smirked at me and did nothing and my co-worker was right there and also saw that she did. so 20 mins later i'm in the office crying because she didn't do anything about the situation. THen my boss askes me whats wrong and i explained to her that i to her this guy just touched my chest and she did nothing about it and the guy had already left. She then told me that she will call him and tell him that he can't come back to this property. But in my head i was thinking he could still go to other properties. She didn't tell me to file a police report even though i did nor did she have me write a written statement of what happen so it can be reported. So I ended up leaving the office and before i did she also made a comment saying why don't you just get a drink or drink a redbull...she made me feel even more that she wasn't taking it seriously...its been a few days since i've been out of work because i'm so scared to go back...and so far i had to file the report so that the police can take care of the situation because my job failed to help me take action against this guy and also the fact that they didn't even ask me if i wanted to go on leave because I wasn't in the right state of mind....do you think i should file a lawsuit against my company??

  1. file a complaint with your company, make a copy for your records. if they do not take action to prevent it in the future you have a case, but a history needs to be established and documented first.
  2. yes, you can, because they are putting you in a situation where you are getting sexually harassed, have knowledge of it, and have not and are not doing anything about it. you can, but if its a big company with a lot of money, you'll probably lose.
  3. TD is right. You have to first have a history of documenting that you have let management know of your issue. The first time something happens, unfortunately isn't enough. You have to actually 'suffer' on more than one occasion and be able to prove that management did nothing to help you out. Getting written documentation from witnesses would be helpful, but still you have to have a history. I'm glad to see that you spoke with the police about this. Get someone on your side to get after that creep! Sorry you had to go through it - sexual harassment s*cks.
