Renting House that got notice of Auction?
We received a notice of auction back at the end of June and the landlord said he was refinancing and not to worry about it, but according to some of the foreclosure websites its still up for auction 9/16. I'm going to call the courthouse Monday morning to verify if the house is still up for auction (hopefully they can tell me), but I'm curious if and when they will come in the home to tell us to vacate the premises?

- Your best bet is to wait for the auction to take place because you are legally liable until to the landlord until the auction. After the auction, immediately call the bank (more than likely the current mortgage company will buy it back). Ask them if they will give you any incentives to move. Most will give you something because it is easier to give you money to move and leave the house in good condition than it would be to get you evicted. After the auction, send a letter to your landlord demanding your deposit back. Give you landlord prorated rent for September and letter stating you will give the full amount if he buys it at the auction. The new owner will have to start formal eviction process, but you should try to settle with them to get a firm move out date and hopefully money.
