We got an eviction notice on my mom's birthday! PLEASE HELP!?
so yesterday, was my mom's birthday . we got an eviction letter last night and we think it's been up there for a while . we were in shock because we hired a foreclosure lawyer that would help us communicate with our lenders better . my dad sent her all the paperwork (bank statements, etc) about 3 weeks ago so she could send them to our lenders . she said everything was going to be OK and that they received the paperwork . now we have no idea what happened and our lawyer isn't calling us back to tell us what went wrong . additional details; -stopped paying mortgage 6 months ago . -got our first notice about 4 months ago (then we hired a lawyer) . -guy stopped buy our house 2 days ago telling us out home was for auction, but my dad told them we were in the process of getting a loan modification, so he went away . -we didn't want to short sell the home because we put so much effort into it . -i think our monthly payments were about 5k . -we live in California . -family of 5 . (mom, dad, me, 2 younger bros [4 & 7]) -the paper said 3 days, but we read online that we actually had 40-60 days . ---->What i want to know is how we can reverse this, how much time we really have & what we did wrong to get this .

- Heck with calling the lawyer, go sit in her office until you get an answer.
- "Hiring a lawyer" does not automatically stop foreclosure procedures. You've been getting the default notices so there should be no surprise here. What does this "lawyer" you're paying have to say?

- The 3 days is to avoid additional damage to your parents credit. Your parents no longer own the house, it was foreclosed. They can redeem, but they need to pay what they owe, plus all of the legal expenses. I am sure they have a huge savings account 6 months and will do what is required to keep you housed, but it will not be in this house. You need to leave. I am not sure what your parents were thinking, they didn't want to sell it because of all that effort, but there is no wya they did not know it would be foreclosed if they refused to repay their loan.
- What makes you or anyone think the lender would care about your moms b day when you have lived payment free for 6 months in the house they paid for?
- Contacting a lawyer does not stop foreclosure. Obviously nothing happened because you are being evicted. Everything is not OK, the home is in foreclosure, sounds as though the auction has already happened and the lender owns the home. If you continue to wait, the Sheriff's will knock on the door, give you about 5 minutes to gather your stuff, and boot you out. You need to contact this lawyer NOW and find out how much time you have because I suspect you only have a couple days. You will lose all the belongings you do not take with you. What you did wrong is not pay the loan, not short sale out of a home that could not be paid for and did not take this seriously.
