Do we need to pay rent on a house that has foreclosed to the new owner?

We have been renting a house for a year and paying rent to a local real estate agent whose brother-in-law owned the house. We paid rent every month, but the owner quit making payments and the house was sold on auction today. The agent said she has our deposit check but won't give it to us until we move out. She said that he could claim all the additional items we paid for out of pocket, (cabinets, ceiling fans ect.) because they are attached to the property even though we had made it clear during the shortsale that the items would be removed and restored to our original move-in condition. I saw that we have 90 days to move out as we were month to month on the rent. They also wanted to do a walk thru the same day to clarify what stays and what goes. She also knows the new owner and says we have to pay him rent as of today (1st of the month) to him because he's the new owner. Should we and can we ask for proof of ownership? Do I pay him the rent or deposit it into a separate account or even pay at all?

  1. well there is no contract in place with the new owner, so I would seek legal counsel.

Go to your local court house where foreclosures are handle and explain they can help you more plus if they can you can start paying rent to the court in an escrow account until this matter is handled correctlyand you can seek a lawyer to verify all and they can't ask you for money without a lease with there names on it if they give you 90 day to move out it has to be court ordered. Best advices stop paying them and take it to small claims you'll get all your money back and some.
  3. I would ask for a new contract, but this is legit. When I lived in a condo, it was sold and we just started paying our rent to the new owner.
  4. you do owe the new owner rent but I would pay them directly. best bet would be to not pay and wait for a bill from new owner. You have no proof that this agent is working for the new owner. you definitely need a statement from new owner as to who to make payments to and the address. I would be hesitant to pay the agent directly.
  5. First of all you do not need to pay a dime to anyone for 90 days. now that said. If you wish to stay then go to the county recorders office in the morning to see who the real owners are and contact them personally. Ask what there intentions are. If they are going to continue to rent the home or not and you would like to stay if at all possible. Get it from the horses mouth. Not some lying realtor.
