Selling handguns at a N. Carolina Gun Show?

I have 2 handguns I would like to sell. I am considering taking them to a gun show and looking for a buyer. What are the legal requirements of selling a handgun between two private individuals at a gun show in North Carolina? Am I better off going through a site like Auction Arms or Gunbroker?

  1. All handgun transfers in North Carolina, whether through a dealer or via private sale, or presented as a gift, require that the intended recipient of the handgun obtain a Pistol Purchase Permit from his/her local Sheriff. You must go to your Sheriff, apply for a Pistol Purchase Permit (one per handgun you wish to purchase), and pay a $5 fee. When you take possession of the handgun you must present the Permit to the seller, who is required to retain it forever. If a Pistol Purchase Permit is not presented, both the buyer and the seller can be convicted of a Class I Misdemeanor. As of 8/10/04 a new law was enacted, which permits someone with a valid North Carolina Concealed Handgun Permit to purchase a pistol without the need to obtain a Pistol Purchase Permit.
  2. Above answer is correct......here is a link. http://www.nraila.org/statelawpdfs/NCSL.pdf
  3. rotor head... unless you all have some registration and transfer rules or waiting period in NC you should be able to carry your pistols in... and make a deal on the floor of the show. That is the notorious "gun show loophole" after all...no more notorious than running an adv in the local paper. If your state has more stringent rules... get a FFL guy with a table to tag your pistols and sell them for a small commission. The shows producer may have a say in what he allows in the venue... but I've never been to a show that did not allow "walk around" trading.
  4. The buyer needs a pistol purchase permit. As the seller you don't need anything but they will give you the permit for your records.
  5. Balt Tigg hooked you up, but this may help clarify...it's a very good read for anyone in NC involved with firearms... http://www.jus.state.nc.us/NCJA/ncfirearmslaws.pdf
  6. Balt's answer is correct but you will probably do better with one of the auction sites simply because tens of thousands of buyers will see it on an auction compared to a few dozen a a gun show. Post them here! Maybe one of us will buy them. .
