renting home but the house is on auction but owner did not tell us what can we do need help asap?

about to months ago we moved into a house and we made a contract with the (supposably) owner of the house and the lease is for every 3 months but recently we been recieving papers saying that the house is in auction and its gonna get auction of 07/07/2010 but the owner did not tell us but it seems like she has been having this problem since 2006 but what can we do?can we get our money back?

  1. You are protected by the federal law called "Protecting Tenants in Foreclosure Act". You need to see a lawyer.
  2. Get what money back? If you've been living there, you owe rent. If you're still living there come August 7th you'll owe rent to the bank or the new owner.
  3. There is no supposed - they DO still own the house until the foreclosure is complete & the auction happens next month. It IS legal to rent out a house that is under foreclosure. They did nothing illegal here. You do not get any rent money back. Tenants under foreclosure have protection under federal law. Once the bank takes possession at auction they are required to let you live out your lease. If it expires before the auction, then they are required to give you 90 days notice. If someone else buys it then they are required to honor your lease as well but can give you 30 days notice if it expires before they take possession.
