Can I Repossess family heirloom (shotguns) if they have been turned into the Police.?

My grandfather who recently passed on had a vast collection of shot guns, muskets and hand guns (some he purchased at auctions, others were handed down through my family. The land our family owns has been in the family for nearly 140 years. Anyways, once he passed on, my Uncle who was the Power of Attorney of the Estate/Will, sold the majority of the guns to an auction house, others that did not have a proper reg code/identification (because they are so old), he turned in to the local police department. The auction house has obviously turned the guns around and sold them already, they are gone for. I was wondering though, is it possible for me to put a claim in or request the guns back from the police department. I am in the middle of getting my Firearms License (I am from Toronto, Canada - so here it's much more strict on the rights to own guns etc.) I do not even want to fire these guns etc., I just wanted to collect them and pass them on to future generations as these are truly family heirlooms. Any help would be appreciated!

  1. Unless your grandfather's will specified that you were to inherit the guns, then you have no legal claim to them. If you possess a valid PAL, ownership could be transferred to you but your uncle (who presumably is executor of the will) would have to allow that. If the guns were surrendered to the police for destruction, it is likely that this has already happened, but your uncle could enquire with the Property Bureau to see if they still have them. If so, and he is willing to assist you, the Property Bureau could be instructed to hold onto them until you get all of your paperwork in order.
