Is this guy breaking the law??

  2. That needs to go to a C&R, or regular FFL holder. Shouldn't be shipped directly to anyone else.
  3. Even though the gun is already in California (just up the road from me even) state law requires that all firearms transfers go thru a federally licensed dealer. So if he ships directly to the buyer yes he will be breaking the law.
  4. Read the disclaimer at the bottom of the page, it clearly states that it must be shipped to a FFL holder. He cannot legally ship that rifle to you direct even though you both live in California. I don't know why he states that he can. Take my advise and get yourself a C&R license, then you can get way better deals anyways and have them shipped direct to you from anywhere in the U.S.
  5. Unless the weapon is classed as a curio or relic, and not a modern firearm, it can only be shipped between FFL dealers or license holders.It CANNOT be shipped directly to a private citizen's address under ANY circumstances.

  10. That rifle should fall under C&R. It cannot be just shipped to whoever sends in money for it. It will need to be either transferred to a C&R holder or transferred to the final purchaser through a FFL holder.
  11. Actually, this guy is not breaking the law. He may be a FFL dealer himself and in CA. He would need your drivers license and to run a background check on you before the transfer takes place, but it is perfectly legal to mail a gun. Lots of people do it when they go on out of state hunting trips and they don't want the hassle of checking a firearm on a plane.
  12. so much bad info, and a little good info from a couple of posters. but: In California, it is required by state law that any firearms sale must go thru an FFL dealer. (That's because of the idiots you sheeple keep electing). The only time you can send a firearm thru the mail as a private citizen, is to or from a place of repair. An FFL holder can mail one to another FFL holder. He cannot sell it and mail it directly to you. That violates federal laws. An FFL dealer can mail it to another FFL holder who can then transfer it to you after you fill out the proper forms. In the remaining free states, He will charge you around $25.00 BUT, in California with all the fee's, charges etc that you people have let the gun grabbers force on you, it can run well over $100.00 in fees.
  13. I am not sure that this is legal. It would be legal for you to send a gun directly to a gunsmith for work to be done on it and for him to return it directly to you. However, this is not your gun and has not been sent in by you to have any work done on it so I suspect there may be some legal questions about sending it directly to you. If you will notice directly above the section labeled "Description", it says in red letters that firearms can be shipped only to FFL holders. You do not appear to fit into any of the categories that would allow you to recieve the gun directly. If I were you and I wanted the gun badly enough, I would call the seller directly and clear up any concerns of legality. You could also contact BATF and ask if such a transfer is legal. You do not have to give the name of the seller but just ask if it is legal to receive a firearm directly from either a dealer, gunsmith or private citizen. If they give the go ahead, then go for it if it is the gun that you want. I wish JD were well and back on line and he could answer this question for you. He is a FFL holder and is familiar with the laws concerning shipping of firearms.
  14. He has to ship it to an FFL where you would then go and pay him around 25.00 to transfer it to you. However in my state I can go to gun shows or garage sells and buy any gun they have with no check what so ever.
